Internal regulations

Article 1:

These regulations are established in accordance with the provisions of Articles L 6352-3 to L. 6352-5 and R 6352-1 to R 6352-15 of the Labor Code
These regulations apply to all trainees and models for the duration of the training taken.
In accordance with article L6352-4 of the labor code, these internal regulations determine:

  1. The main health and safety measures applicable in the establishment
  2. The rules applicable to discipline, in particular the nature and scale of sanctions applicable to trainees and their rights in the event of sanctions
  3. The arrangements for ensuring the representation of trainees for training activities with a total duration of more than five hundred hours. (where applicable: see)

HEALTH AND SAFETY

Article 2:

Preventing the risk of accidents and illnesses is imperative and requires everyone to fully comply with all applicable health and safety regulations. To this end, the general and specific safety instructions in force within the organization, where they exist, must be strictly observed under penalty of disciplinary sanctions.
The intern or model is responsible for their personal belongings and items. They must appear in proper attire.

GENERAL DISCIPLINE

Article 3:

Trainees are strictly prohibited from:

  • to enter the establishment while intoxicated
  • to bring alcoholic beverages into the premises
  • to leave the internship without reason
  • to take any object without written authorization
  • to modify training materials
  • to eat in the classroom
  • to use the mobile phone during the session unless agreed
  • to smoke in the premises.

SANCTIONS

Article 4:

Any action considered to be at fault by the director of the training organization or his representative may, depending on its nature and seriousness, be subject to one or other of the following sanctions in order of importance:

  • written warning by the Director of the training organization or by his representative
  • blame
  • permanent exclusion from training

DISCIPLINARY GUARANTEES

Article 5:

No sanction may be imposed on the intern without the latter being informed at the same time and in writing of the grievances against him.

Article 6:

When the director of the training organization or his representative is considering taking a sanction, he summons the trainee by registered letter with acknowledgment of receipt or delivered to the person concerned against discharge, indicating the purpose of the summons, the date, time and place of the interview, unless the sanction envisaged is a warning or a sanction of the same nature which has no immediate impact or not on the presence of the trainee for the continuation of the training.

Article 7:

During the interview, the intern may be assisted by a person of their choice, whether an intern or an employee of the organization. The summons mentioned in the previous article states this option.
During the interview, the reason for the proposed sanction is indicated to the trainee, from whom explanations are obtained.

Article 8:

The sanction cannot be imposed less than one clear day nor more than 15 days after the interview or, where applicable, after the transmission of the opinion of the Disciplinary Committee.
It is the subject of a written and reasoned notification to the trainee in the form of a letter delivered against receipt or a registered letter.

Article 9:

When an action considered to be at fault has made a precautionary measure of temporary exclusion with immediate effect essential, no definitive sanction relating to this action may be taken without the trainee having been previously informed of the grievances against him and, where appropriate, without him having been summoned to an interview and given the opportunity to be heard by the disciplinary committee.

Article 10:

The director of the training organization informs the employer, and possibly the joint body responsible for training costs, of the sanction taken.

REPRESENTATION OF INTERNS

Article 11:

For each course lasting more than 500 hours, a full delegate and a substitute delegate are elected simultaneously by two-round single-member ballot.
All trainees are eligible to vote, except for prisoners admitted to participate in a vocational training program.

Article 12:

The director of the training organization organizes the vote which takes place during training hours, at the earliest 8 p.m. and at the latest 40 hours after the start of the training.
When the representation of trainees cannot be ensured, he draws up a report of deficiency which he transmits to the territorially competent regional prefect.

Article 13:

Delegates are elected for the duration of the training course. Their terms of office end when they cease, for whatever reason, to participate in the training course.
If the main delegate and the substitute delegate have ceased their functions before the end of the training period, a new election will be held under the conditions provided for in Articles R.6352-9 to R.6352-12.

Article 14:

The delegates make any suggestions to improve the running of the training courses and the living conditions of the trainees in the training organization. They present all individual or collective complaints relating to these matters, to health and safety conditions and to the application of the internal regulations.

PUBLICITY OF THE REGULATIONS

Article 15:

A copy of these regulations is given to each trainee (before any final registration).
